| Seamiles Participant Terms and Conditions
Please read these Seamiles(TM) Participant Terms and Conditions with care before registering as a member of the
Seamiles programme. It is your responsibility to read and understand them, and to review them on a regular basis
for any amendments that may have been made. Your participation in the Seamiles programme will be taken to be
your acceptance of these Terms and Conditions (as they are amended from time to time).
General
| 1. |
The entire Seamiles programme is only offered via the official Seamiles website. |
| 2. |
Participation in the programme and its benefits are offered at the discretion of Seamiles
(NZ) Limited and is subject to these Terms and Conditions. |
| 3. |
Registration will create a legal agreement between you and Seamiles (NZ) Limited. |
| 4. |
By participating in the Seamiles programme you agree to adhere to these Seamiles Participant
Terms and Conditions, and any changes to them, in whole or in part, at any time with or without notice. |
| 5. |
To de-register from the Seamiles Programme, please call Armacup Maritime Services Limited. |
Eligibility
| 1. |
You must be both a New Zealand resident and a current Registered Trader. |
| 2. |
You must provide Seamiles (NZ) Limited your email address and other personal details to
participate in the SeaMiles programme and advise us promptly of any changes. |
| 3. |
You must only register for ONE Seamiles membership account. Duplicate Seamiles membership
accounts will be deleted with loss of all Seamiles points credited to the duplicate account. |
| 4. |
You must not be an employee of Seamiles (NZ) Limited, or an employee of a competitor of
Seamiles or Armacup Maritime Services Limited. |
Relationship
Your relationship with us will be as a member of the Seamiles programme. This is governed by these terms and
conditions.You will not be an employee of Seamiles (NZ) Limited or a partner or have any other form of
relationship or association with us.
Communications and Newsletter
| 1. |
Our communications with you will normally be by e-mail. |
| 2. |
In addition you also agree to allow Seamiles (NZ) Limited to send you newsletters at our discretion.
Our present intention is to do so at regular intervals. |
| 3. |
You can cancel your subscription to the newsletter at any time via the Membership Services section
on the Seamiles website. Cancelling your newsletter subscription will have no bearing on your membership status. |
| 4. |
From time-to-time, Seamiles (NZ) Limited may make you aware of special offers from other companies that
your SeaMiles can be redeemed for. |
Account access
| 1. |
SeaMiles will provide access to your Seamiles account details via the Seamiles website. |
| 2. |
The Seamiles Membership Services area will allow you to:
- Update your personal details stored by Seamiles (NZ) Limited
- Verify Seamiles credited, and check your Seamiles account balance |
| 3. |
SeaMiles will provide access to your Seamiles account details via the Seamiles website. |
| 4. |
You will need your username and password to access your account. |
Redemption of Seamiles
| 1. |
You will need to provide a username and password when wanting to redeem Seamiles. |
| 2. |
Seamiles can be redeemed for products and services offered by Seamiles (NZ) Limited from time-to-time. |
| 3. |
Seamiles are exchanged for purchase orders, for goods or services you have selected from a Seamiles
nominated supplier. |
| 4. |
'purchase orders', may contain additional terms and conditions, including expiry dates, which are in
addition to the Seamiles Participants Terms and Conditions. |
| 5. |
Seamiles (NZ) Limited assume no liability for third party supplied offers, products or services,
and these may be withdrawn or changed at any time. |
| 6. |
Seamiles 'purchase orders' are non-transferable. |
| 7. |
Seamiles (NZ) Limited are not responsible for any credits or debits made to your Seamiles account by
someone else who uses your email address and password. |
| 8. |
Seamiles are the sole currency of the Seamiles programme. |
| 9. |
Armacup Maritime Services and / or Seamiles Limited, reserve the right to adjust the value of Seamiles
Points without notice. |
Receiving Seamiles
| 1. |
As a participant in the Seamiles programme you are entitled to receive Seamiles for each used motor
vehicle imported from Japan to New Zealand at a rate of 20 points per motor vehicle. |
| 2. |
Seamiles (NZ) Limited may revoke Seamiles if it finds that you are in breach of this agreement. |
| 3. |
Seamiles are credited to your account once full payment is made for each shipment. |
| 4. |
It is your responsibility to regularly check your account balance to ensure Seamiles have been
correctly credited to your SeaMiles account. |
| 5. |
You will be solely responsible for all tax liability arising from your receipt and redeemption of Seamiles. |
| 6. |
Seamiles will expire if there has not
been shipment consignments scheduled or paid for with Armacup for a period
of six months. Seamiles must also be redeemed within twelve months from the
dated issued. |
| 7. |
Seamiles have no cash value. |
| 8. |
Seamiles are not transferable to dealer customers. |
| 9. |
Staff and families of Armacup Maritime Services are not eligible for Seamiles. |
| 10. |
Dealers who are not Registered Traders do not qualify for Seamiles. |
Privacy and security
| 1. |
In ALL instances, Seamiles (NZ) Limited are committed to protecting your privacy. |
| 2. |
You are solely responsible for maintaining the confidentiality of your Seamiles account username
and password details. |
| 3. |
All records held by Seamiles (NZ) Limited shall be stored and retrieved in a secure environment to
the best of Seamiles (NZ) Limited's ability. |
| 4. |
Seamiles (NZ) Limited cannot be held responsible for the illegal entry to its network by a third party,
or the for use of data obtained illegally, or for any technical or other breakdown or for any matters
or events beyond its control or for any consequences arising from any such entry, breakdown or other
such matters or events. |
| 5. |
Seamiles (NZ) Limited will take reasonable steps to ensure that its operating environment is virus
free, but does not accept any responsibility for ANY damage caused by downloading the Seamiles site contents,
however arising. |
Disclaimer and limitation of liability
| 1. |
The Seamiles programme is offered to you as a participant 'as is' and with NO WARRANTY either expressed
or implied. |
| 2. |
SeaMiles (NZ) Limited does not warrant, guarantee, or make any representations of any kind for any
merchandise, products, or services offered or provided by, in exchange for Seamiles points except to the extent
required by any mandatory law. |
| 3. |
Seamiles (NZ) Limited does not warrant that access to the site will be uninterrupted or error-free. |
Termination
| 1. |
Seamiles (NZ) Limited reserves the right to terminate the Seamiles programme at any time with 30 days
notice and without being required to give any reasons or explanations. |
| 2. |
You will have 30 days from the date the notice of termination is given to Seamiles participants in which to
redeem any accumulated Seamiles. |
| 3. |
Continuation of membership depends on and is subject to your compliance with membership terms and
conditions. Any failure to comply with these Terms and Conditions, including fraud or abuse relating to the accrual
or redemption of Seamiles, will give Seamiles (NZ) Limited the immediate right to terminate your membership of
the Seamiles programme without notice. |
Notice
| 1. |
Programme termination notice will be by way of email, sent to your email address, as advised by you, or
alternatively via physical mail where no email address exists on file. |
| 2. |
Seamiles (NZ) Limited are not responsible for any failure leading to your non-receipt of the notice
of termination notification. |
Disputes and / or errors
| 1. |
All disputes will be held in confidence between Seamiles (NZ) Limited and the member who registers the dispute. |
| 2. |
All disputes will be dealt with in a timely manner, with compensation (if any) being by way of Seamiles
points being credited to the members Seamiles account. |
| 3. |
This agreement shall be governed by and construed in accordance with the laws of New Zealand. |
